Welcome to Truebalance-Telehealth PLLC (“Truebalance Telehealth,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website www.truebalancetelehealth.com (the “Site”) and the telehealth services we provide. By accessing or using the Site, scheduling a telehealth appointment, or receiving services from us, you agree to these Terms.

If you do not agree with any part of these Terms, please do not use our Site or services.

1. Nature of Services

We provide cash-pay telehealth medical services, including hormone replacement therapy (HRT), consultations, evaluations, and treatment plans. All medical services are provided by a licensed healthcare provider.

We do not accept insurance. All fees are paid directly by patients.

2. Telehealth Services

By scheduling or participating in a telehealth visit, you acknowledge and agree that:

  • Telehealth involves electronic communication of your medical information.
  • Telehealth has limitations, including the potential for incomplete data or technology issues.
  • Your provider may determine that telehealth is not appropriate and may recommend in-person care.
  • You must be physically located in a state where the provider is licensed at the time of the visit.
  • You are responsible for ensuring a private, safe environment for your telehealth appointment.

3. Patient Responsibilities

By using our services, you agree to:

  • Provide accurate, truthful, and complete information during intake and consultations.
  • Inform your provider about any changes in your health or medications.
  • Follow medical advice and treatment instructions provided to you.
  • Seek emergency care immediately if you believe you are experiencing a medical emergency.
  • Use the telehealth platform responsibly and not engage in any illegal, abusive, or inappropriate behavior.

4. Payment & Fees

  • We operate on a cash-pay model.
  • Payment is due at the time services are rendered or as otherwise communicated.
  • Fees may include consultation charges, ongoing treatment fees, labs (if applicable), and medications.
  • Medications prescribed through third-party pharmacies are billed separately by those pharmacies.

We reserve the right to change pricing at any time.

5. Refunds & Cancellations

Unless otherwise stated:

  • Consultation fees are non-refundable once the visit begins.
  • No-shows or cancellations less than 24 hours before your appointment may result in a fee.
  • Prepaid programs or memberships follow their own refund and cancellation rules, if applicable.

A separate Refund/Cancellation Policy can be provided upon request or posted on our Site if needed.

6. No Medical Emergencies

We do NOT treat medical emergencies. If you are experiencing chest pain, severe shortness of breath, suicidal thoughts, allergic reactions, or any other emergency, call 911 or go to your nearest emergency room.

7. Prescription Policy

  • Medications can only be prescribed after a clinical evaluation by our provider.
  • We reserve the right to refuse or discontinue medications if medically inappropriate or unsafe.
  • Controlled substances are generally not prescribed through our service.
  • Medication availability, pricing, and shipping are determined by the dispensing pharmacy, not Truebalance-Telehealth.

8. Use of the Website

You agree not to use the Site:

  • For any unlawful purpose
  • To impersonate another person
  • To upload harmful or disruptive content (e.g., malware)
  • To attempt unauthorized access to any systems or data

We may restrict or terminate access to the Site for violating these Terms.

9. Intellectual Property

All content on the Site - including text, graphics, logos, images, videos, and design elements - is owned by Truebalance-Telehealth or licensed to us. You may not copy, reproduce, distribute, or use any content without our prior written permission.

10. Privacy and HIPAA

Your use of the Site is governed by our Privacy Policy, which explains how we collect and use information. If you receive medical services, your Protected Health Information (PHI) is also protected by the HIPAA Notice of Privacy Practices, which outlines your rights and our responsibilities under federal law. We do not store PHI on our public website. All PHI is handled through external HIPAA-compliant systems.

11. Third-Party Services

Our Site may include links or integrations to third-party services, including:

  • Telehealth platforms
  • HIPAA-compliant forms
  • Pharmacies
  • Laboratories
  • Payment processors

We are not responsible for the content, security, or privacy practices of third parties. Your use of those services is subject to their own terms.

12. Disclaimers

  • Information provided on the Site is for general informational purposes and is not medical advice.
  • Telehealth has limitations, and outcomes may vary.
  • We make no guarantees about treatment effectiveness or results.
  • Our services are provided “as is” without warranties of any kind.

13. SMS Communications Terms

By opting in to SMS messages from us, you agree to receive text messages for customer support, appointment reminders, service updates, and other communications related to your care and account.

  • You can cancel the SMS service at any time. Just text STOP. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
  • If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance.
  • Carriers are not liable for delayed or undelivered messages.
  • Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

14. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, consequential, or punitive damages.
  • Our total liability for any claim relating to services or the Site is limited to the amount you paid for those services.

This limitation does not apply where prohibited by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Truebalance-Telehealth and its providers from any claims, damages, losses, or expenses arising out of:

  • Your use of the Site or services
  • Your breach of these Terms
  • Your violation of any law or rights of a third party

16. Changes to These Terms

We may update these Terms periodically. When we do, the “Effective Date” at the top will be updated. Your continued use of the Site constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
